The Director of Public Prosecutions (DPP) has secured a life imprisonment sentence against three convicts following their conviction for robbery with violence and gang rape in Nyeri.
The three, Samuel Kabutu Kiunuhe, Michael Ndungu Kiritu and Daniel Muraguri Wangari, were charged with robbery with violence contrary to Section 296(2) of the Penal Code and gang rape contrary to Section 10 of the Sexual offences Act following an incident that occurred on 11 April 2023 at Kiamwathi area in Nyeri County.
The particulars of the case were that the three, while armed with a knife and acting jointly, robbed the complainant of various household items and subjected her to violence during the incident.
The first and second accused persons were further charged with gang rape contrary to Section 10 of the Sexual Offences Act, while the third accused was charged with gang rape on the basis of common intention.
During the trial, the prosecution, led by Prosecution Counsel Ms. Obat, presented evidence from the seven prosecution witnesses.The court heard that the complainant identified the perpetrators and that DNA analysis conducted by the government chemist matched the samples obtained from the complainant to Michael Ndungu Kiritu and Samuel Kabutu Kiunuhe
The court also found the identification evidence against the third accused sufficient to place him among the perpetrators.In its judgment, the court found that the prosecution had proved the charges beyond reasonable doubt and consequently convicted all three accused persons of robbery with violence and gang rape.
The judgment was delivered at the Chief Magistrateโs Court in Nyeri by Senior Resident Magistrate Hon.
Mary Gituma, who found that the prosecution had adduced sufficient evidence to establish the charges against the three accused persons.
The court subsequently sentenced the three convicts to life imprisonment for the offence of robbery with violence and 20 years imprisonment for gang rape, for each convict, with the sentences running concurrently.
The outcome underscores the ODPPโs commitment to ensuring that perpetrators of serious offences are brought to justice while upholding the rights of victims and the rule of law.
