DPP successfully opposes bail for Chinese national facing extradition to Uganda
The Director of Public Prosecutions (ODPP) has successfully opposed a renewed bail application by Chinese national Chen Guang alias Alex, with the Chief Magistrate’s Court at Milimani declining to release him for the second time pending extradition proceedings to Uganda.
The decision followed submissions by the Prosecution, which maintained that the circumstances previously relied upon by the Court to deny bail remained unchanged. Chen is wanted in Uganda to face 30 counts of forgery and one count of theft.

In its submissions, Prosecution placed particular emphasis on Chen’s short-term tenancy agreement in Kenya, arguing that temporary accommodation did not demonstrate sufficiently established residential ties to justify his release. The DPP further submitted that his lack of ordinary residence in Kenya and significant international mobility continued to present a real and substantial risk of absconding.
Further, Prosecution challenged the adequacy of the proposed bail conditions, including the surrender of his passport, periodic reporting to a police station and provision of sureties, arguing that these measures would not sufficiently address the identified flight risk.
Prosecution led by Senior Assistant Director of Public Prosecutions, Duncan Ondimu, OGW and Prosecution Counsel Fatma Shaban, maintained that the extradition proceedings should be determined expeditiously while Chen remains in custody, to safeguard the process and ensure his continued availability for the proceedings.
